Terms of Service

These Terms of Service ("Terms") govern your access to and use of the PDR Mobile web application, mobile applications, and related services (collectively, the "Service") provided by PDR Mobile ("PDR Mobile", "we", "us", or "our"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. The Service

PDR Mobile is a business-management tool for paintless dent repair (PDR) professionals. Features include estimate and invoice creation, customer and location management, photo documentation, AI-assisted panel scanning (iScan, where available), team and commission management, and multi-location support. We may add, modify, or remove features at any time.

2. Eligibility

You must be at least 18 years old and capable of forming a binding contract to use the Service. By creating an account, you represent that you meet these requirements and that the information you provide is accurate.

3. Accounts and Members

A PDR Mobile account is owned by the individual or business entity that created it. The owner may invite team members (technicians, staff) and assign roles that grant permissions within the account. Each user must have their own login credentials; sharing accounts is not permitted.

You are responsible for safeguarding your password and for all activity that occurs under your account. Notify us immediately of any unauthorized use.

4. Free Trial, Subscription, and Billing

Free trial

New accounts may be offered a 30-day free trial. No payment method is required to start. At the end of the trial, you must subscribe to a paid plan to continue using the Service.

Subscription

The Service is sold by subscription. Pricing is shown on the Pricing page and includes a base plan plus optional add-ons such as additional team-member seats and, when available, iScan. Billing cycles are monthly or annual at your choice. Subscription fees are billed in advance and are non-refundable except where required by law.

Payment processing

Payments are processed by Stripe under their terms and security practices. By providing payment information, you authorize us (through Stripe) to charge your payment method for recurring subscription fees, applicable taxes, and any add-on purchases (for example, iScan top-up packs).

Plan changes and seats

You may add or remove team-member seats and optional add-ons during your subscription. Changes are pro-rated to your current billing cycle. Downgrades take effect at the start of the next cycle.

iScan credits

Where iScan is offered, subscribed iScan plans include a monthly allotment of scans that resets each billing cycle and does not roll over. Top-up scan packs purchased separately do not expire and are consumed after the monthly allotment is used.

Failed payments

If a payment fails, we will retry and notify you. If payment is not received, we may suspend or restrict access to the Service until your account is current.

Cancellation

You may cancel your subscription at any time from your billing page. Cancellation takes effect at the end of the current billing period, and you retain access until that date. We do not provide pro-rated refunds for unused time.

Price changes

We may change subscription prices. We will give at least 30 days' notice before a price change takes effect on your account, and you may cancel before the new pricing applies.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law;
• Reverse-engineer, decompile, or attempt to extract source code, except as permitted by law;
• Probe, scan, or test the vulnerability of the Service, or breach any security or authentication measure;
• Resell, sublicense, or otherwise commercially exploit the Service except as expressly permitted;
• Upload content that is unlawful, infringing, defamatory, or otherwise objectionable;
• Use the Service to send unsolicited or unauthorized commercial communications;
• Interfere with or disrupt the Service or its infrastructure;
• Use automated means to access the Service except via documented APIs we provide;
• Use the iScan feature to submit content other than vehicle panel images for the purpose of damage assessment.

6. Your Content

You retain all rights to the data, photos, documents, and other content you upload or create in the Service ("Your Content"). You grant us a limited, worldwide, royalty-free license to host, store, transmit, process, and display Your Content solely as necessary to operate and provide the Service to you and your team — including, when you use the iScan feature, processing panel images through our AI inference partner.

You represent that you have all rights necessary to upload Your Content and that it does not infringe any third-party rights.

7. Our Intellectual Property

The Service, including its software, design, trademarks, logos, and content we create, is owned by PDR Mobile and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your business purposes during your subscription. Nothing in these Terms transfers ownership of the Service or any portion of it to you.

8. Third-Party Services

The Service integrates with third-party providers including Stripe (billing), Tractable (AI panel scanning), and authentication providers (Google, Apple). Your use of these features is also subject to the respective third-party terms and privacy policies. We are not responsible for the practices of third parties.

9. AI and iScan Disclaimer

Where available, iScan provides AI-assisted estimates of dent counts and sizes. Results are probabilistic and may be inaccurate. They are intended as a starting point for a professional estimate, not a substitute for your judgment. You are solely responsible for the accuracy of any estimate or invoice you provide to your customers.

10. Disclaimer of Warranties

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or that defects will be corrected. Use of the Service is at your own risk.

11. Limitation of Liability

To the maximum extent permitted by law, PDR Mobile and its affiliates, officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the Service. Our total aggregate liability for any claim under these Terms will not exceed the amount you paid us in the twelve (12) months preceding the event giving rise to the claim.

12. Indemnification

You agree to indemnify and hold harmless PDR Mobile and its affiliates from any claim, loss, liability, or expense (including reasonable attorneys' fees) arising from your use of the Service, Your Content, or your violation of these Terms or applicable law.

13. Suspension and Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for conduct we believe violates these Terms or is otherwise harmful to PDR Mobile or other users. You may terminate your account at any time by canceling your subscription. Upon termination, your right to use the Service ends immediately. Sections of these Terms that by their nature should survive termination will survive (including ownership, disclaimers, limitations of liability, and dispute resolution).

14. Changes to the Service or Terms

We may modify the Service or these Terms at any time. If we make material changes to these Terms, we will notify you by email or through an in-app notice before the changes take effect. Your continued use of the Service after changes become effective constitutes your acceptance of the revised Terms.

15. Governing Law and Disputes

These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service will be resolved exclusively in the state or federal courts located in Texas, and you consent to the personal jurisdiction of those courts.

16. Miscellaneous

These Terms, together with our Privacy Policy, constitute the entire agreement between you and PDR Mobile regarding the Service and supersede any prior agreements. If any provision is held invalid, the remaining provisions will continue in effect. Our failure to enforce a provision is not a waiver of our right to do so later. You may not assign these Terms without our written consent; we may assign them without restriction.
